Dear Honorable Janet Austin OBC,

On 3 December, 2020 the Lieutenant Governors of the ten provinces, the Commissioner of the Northwest Territories and the Governor General of Canada were placed on Notice to provide written proofs of claim to validate current emergency measures. Only a single response was received from the office of British Columbia’s Honorable Janet Austin, OBC, and it did not meet, nor satisfy, the terms and conditions of the initial Notice.

Failure to isolate the SARS-COV-2 virus deems all orders and mandates surrounding the continued declarations of emergency – including all orders, mandates and fines – a direct violation of Constitutional and Charter Rights and a violation of the Nuremberg code. All damages incurred stemming from the failure or unwillingness to produce evidence of an isolated SARS-COV-2 virus are also subject to this notice.

At the time of the first announced lockdown, Canada’s population was approximately 38,000,000 and there were only two COVID-19 “related” deaths at that time, meaning all provincial and territorial declarations were excessive, unreasonable and unjustified. Eleven months into said pandemic, the current population of Canada is 38,112,514 as of February 16, 2021, approximately 112,514 greater than at the installation of province wide states of emergencies.

On March 18, 2020 a declaration of a provincial state of emergency in British Columbia pursuant to subsection 9.(1) of the Emergency Program Act.

DEFINITION“emergency” means a “present” or “imminent” event or circumstance that: (a)is caused by accident, fire, explosion, technical failure or the forces of nature, and (b)requires prompt coordination of action or special regulation of persons or property to protect the health, safety or welfare of a person or to limit damage to property

“14 days to flatten the curve” has turned into eleven months of closures, excessive and intrusive public health policy, economic devastation, unconstitutional confinement measures, and a swift dismantling and disregard for democracy, the Canadian Constitution and the Canadian Charter of Rights and Freedoms in the forms of:

Failing to independently isolate the SARS-COV-2 virus

Incessant PCR testing that has inconsistent amplification requirements by Province, produce proven +/- 50% false-positive rates and because the PCR primer sequence is found in all human DNA, PCR test results cannot reliably determine the presence of the SARS-COV-2 virus, to warrant any state of emergency

Rushed trials of a chemical pathogen device, which is not a vaccine by definition yet marketed as such, resulting in injuries and deaths, many unreported (VAERS)

Increased unemployment rates due to mass closures (see provincial stats in Notice)

Mass business closures due to designation as non essential services under emergencies acts increase in business closures and decline in openings, (88,187 jobs = 125.6% in April 2020 alone, StatsCan)

Restricted travel/movement, violating section 6 of the Canadian Charter of Rights and Freedoms, such as: Quarantine encampment imprisonment against free will and under duress, violating The Canadian Charter of Rights and Freedoms sections:

• 6. (1) Every citizen of Canada has the right to enter, remain in and leave Canada.
• 8. Everyone has the right to be secure against unreasonable search or seizure.
• 9. the right not to be arbitrarily detained or imprisoned.
• 10.the right on arrest or detention:
• (a) to be informed promptly of the reasons therefor;
• (b) to retain and instruct counsel without delay and to be informed of that right; and
• (c) to have the validity of the detention determined by way of habeas corpus and to be released if the detention is not lawful.

Increased depression, suicide and addiction rates due to prolonged lockdowns for an unisolated virus

Mental and emotional repercussions due to restrictions on proper childhood education and care.

Increased rates of in home childhood and adult abuse due to lockdowns

Lieutenant Governor’s failure to hold Ministers responsible for regulatory boards compelling medical practitioners to violate hippocratic oaths with no repercussions of medical malpractice, so long as they are not bad actors in the eyes of parliamentary orders that then violate charter and constitutional rights as well as fundamental principles of the Nuremberg Code.

Lieutenant Governor’s failure to hold Ministers responsible for the College of Physicians and Surgeons and the doctor’s underneath the College of Physicians and Surgeons, accountable for violating various sections of Terms of Use for Social media and Hippocratic Oaths, including but not limited to:

• Non compliance of relevant legislation with respect to physician advertising of masks, PCR tests and “vaccinations”.
• physician advertising, please see Part II of O.Reg., 114/94, enacted under the Medicine Act, 1991, S.O. 1991, c. 30.
• 7. (1) A member shall not participate directly or indirectly in a system in which another person steers or recommends people to a member for professional services. O. Reg. 114/94, s. 7 (1).

Imprisonment and isolation of the elderly resulting in a subsequent disproportionate number of COVID-19 related deaths in long term care facilities from March 2020 to present day, under the declarations of emergency for COVID-19. (81% of COVID-19 related deaths occured in Canadian LTC facilities).

Closures and restrictions on places of worship which are violations of The Canadian Charter of Rights and Freedoms, sections

• 2(a) Freedom of Conscience, religion and thought
• 2(c) Freedom of peaceful assembly and
• 2(d) Freedom of association

This is your second notice to provide proof within 10 days of receipt of this notice. Please be reminded that failure to provide the proofs of claim laid out in our initial notice will be deemed to mean no such proof exists and that you, Honorable Janet Austin, OBC, in your capacity as Lieutenant Governor, are not in possession of the evidence required to justify invoking and upholding a Declaration of Emergency related to COVID-19 and the novel coronavirus.

Further, this will mean you, Honorable Janet Austin OBC, recognize that prolonged lockdown of our Province will have devastating effects on our economy and the collective well-being of our people and have confirmed you will accept full commercial liability for any and all damages associated with these measures, for which future notices of claim may follow.
